  1. The following terms are used throughout these Terms & Conditions and have specific meanings.
    1. The term “Service” refers to the services provided by NZ Media, LLC through Turbine, including web pages, online and offline document storage, payment portals, organizational tools, and user interfaces.
    2. The term “Agreement” refers collectively, to all the terms, conditions, and notices contained or references in this document.
    3. “Turbine”, “the App”, and “Website” refer to the website located at https://turbinenote.com/, all subdomains, subpages, content, user interfaces, services, and products available at or through the website.
    4. “We”, “Us”, and “NZ Media” refer to NZ Media, LLC as well as our subsidiaries, employees, and associates.
    5. “User”, “Users”, “You”, and “Your” refer to the person, company, or organization accessing the Website and/or using the Service.
    6. The term “Account” refers to a profile for a User identified by the User's email address.
  2. Conditions
    1. You must be over 13 years old to use the Service or create an Account.
    2. You may not upload computer generated content, randomly generated content, or spam.
    3. The User is responsible for Account security by means of protecting passwords, using a secure and unique password, and not sharing the password with anyone.
    4. We retain the right to delete or revoke any Account for any reason including, but not limited to, abuse of the Service.
    5. Users may not engage in any activity that tampers with the Service or causes disturbance to the operation of the Service.
    6. You may not engage in any illegal, misleading, or fraudulent activity through the Website.
    7. You may not impersonate others or provide inaccurate information to Us.
    8. You may not sell, license, or otherwise distribute information obtained through use of the Service
    9. You may not sell or license any Account to any third party without our written consent.
    10. We have no obligation to store, maintain, or otherwise deliver data provided through the Service. We do not have to provide You with a copy of any information You provided to us.
    11. NZ Media may change the price of any subscription or create new subscriptions at any time without notice to the Users
    12. We may update or remove any data accessed through our service for any reason.
    13. Users who create an Account are bound to these terms.
    14. You may not attempt to create a new Account if you have already created an Account or have been denied or revoked an Account for any reason in the past.
  3. Limitation of Liability & Indemnity
    1. Neither party will hold the other party responsible for content provided by Users of Turbine
    2. You agree that we won't be responsible ("liable") for any lost profits, revenues, information, or data, or consequential, special, indirect, exemplary, punitive, or incidental damages arising out of or related to this Agreement, even if we know they are possible. This includes when we delete Your content, information, or Account. Our aggregate liability arising out of or relating to these Terms will not exceed the greater of the amount you have paid us in the past twelve months or $100.00.
    3. Our Service is provided "as is," and we can't guarantee it will be safe and secure or will work perfectly or be available all the time. TO THE EXTENT PERMITTED BY LAW, WE ALSO DISCLAIM ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
    4. You agree to defend, indemnify and hold us harmless from and against any claims, liabilities, damages, losses, and expenses, including without limitation, reasonable attorney's fees and costs, arising out of or in any way connected with this Agreement or Your use of the Service. You will cooperate as required by us in the defense of any claim.
  4. Severability

    Any part, provision, or representation of this Agreement which is prohibited or which is held to be void or unenforceable shall be ineffective to the extent of such prohibition or unenforceability without invalidating the remaining provisions hereof.
  5. Changes to this Agreement

    We will notify You before We make changes to this Agreement, and give you an opportunity to review the changes before they go into effect. Should you continue to use the Service after changes have been made, you will be bound by the updated Agreement. Should you choose not to agree to the new terms, you may have an account deleted by sending an email to accounts@turbinenote.com
